Forty-Three Percent of Chief Litigation Officers Believe Executives Are Inadequately Educated on Legal Risk

Screen Shot 2015-11-29 at 1.52.09 PMBETHESDA, MD – (Nov. 16, 2015) – Nearly half (43%) of Chief Litigation Officers believe corporate executives are not adequately educated on legal risk, a new survey by Consero Group has found. The international leader in creating high-level, invitation-only events for senior executives compiled and reported these results as part of the October 2015 Corporate Litigation Survey.

In addition, 35 percent of executives surveyed reported that their department budget had decreased in the past year, while 30 percent of Chief Litigation Officers said their budgets were static. A majority of executives (68%) reported that the size of their litigation staff had remained unchanged in the last 12 months.

“It is disconcerting that a significant portion of Chief Litigation Officers do not believe their executives are adequately educated on legal risks,” said Paul Mandell, Founder & CEO of Consero. “Given that informed executive leadership can improve the allocation of resources to mitigate legal risks, Chief Litigation Officers may want to spend more time in the coming months to educate their senior leadership team to ensure receipt of necessary departmental support.”

Additional Findings Included:

  • Alternative Fee Arrangements on the Rise: Nearly half (47%) of Chief Litigation Officers reported that their use of alternative fee arrangements had increased in the past year.
  • Relationships with External Regulators Are Positive: Only 14 percent of CLOs believe that their relationship with external regulators is negative.
  • Little Increased Delegation to Outside Counsel: Eighty-eight percent of legal executives said that they had not delegated more legal work to outside counsel since last year.

The 63 survey respondents included Chief Litigation Officers from Fortune 1000 companies.
